LEGAL · TERMS OF SERVICE
The contract between EV·Surveys Ltd and the firm or individual that opens an account. It covers the app, the website and the operations view, alongside any data processing agreement.
01 · THE AGREEMENT
These terms form a contract between EV·Surveys Ltd (“we”, “us”) and the firm or individual that opens an account (“you”). They apply to the app, the website and the operations view together with any data processing agreement signed alongside them.
Where a separately signed order form or enterprise agreement with your firm differs from these terms, that agreement takes precedence for your firm.
02 · ACCOUNTS AND USE
You are responsible for your account, the engineers you add to it, and keeping credentials secure. You agree to use the service lawfully and only for genuine survey and installation work.
03 · PLANS AND BILLING
Plans are priced per engineer, as set out on the pricing page. Surveys and evidence pack exports are unlimited on every plan.
04 · YOUR DATA
Survey evidence and the data you enter are yours. We claim no ownership of it and do not use it for our own purposes or to train models. We process it to provide the service, as a processor on your firm's behalf, under the data processing agreement and the privacy policy.
Exported packs are self-contained and remain verifiable without an account. On termination you can export your data; see section 08.
05 · PROFESSIONAL RESPONSIBILITY
EV·Surveys records evidence and runs supporting checks. It does not replace the judgement, qualifications or sign-off of a competent person. The installer remains the responsible party for the survey, the design, the work and its compliance with BS 7671, the Public Charge Point Regulations 2023, Part P, PAS 1899 and any other applicable standard.
Calculations and prompts in the app are aids, not certifications. You are responsible for verifying anything the app flags before you rely on it.
06 · AVAILABILITY
Capture, hashing and signing run on the device and do not depend on our servers. Online features (timestamp anchoring, backup, the operations view) are provided on a reasonable-efforts basis and may occasionally be unavailable for maintenance. We aim to give notice of planned maintenance where practical.
07 · LIABILITY
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited by law. Subject to that, our total liability in any 12-month period is limited to the fees you paid in that period.
We are not liable for indirect or consequential loss, or for loss arising from your reliance on the app in place of professional judgement as described in section 05.
08 · TERMINATION
You can cancel at any time from your account. We may suspend or end access for serious or repeated breach of these terms, with notice where the law allows.
For 30 days after termination you can export your data. After that, and subject to the retention periods in the privacy policy, we delete it. Packs you have already exported are unaffected and stay verifiable.
09 · GOVERNING LAW
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. We may update these terms; we will post the new version here with a revised date, and material changes will be notified to account holders.
